Rights of Title Deeds Ignored

 

Home owners in the Anderson Drive, Burns Road, Braes Court and Hillview Avenue area of Darvel are up in arms that their public open space and children’s play areas are being earmarked for house building. They have enlisted the support of local MP Des Browne. Des has seen one set of the owners Title Deeds and has discovered that it gives the owner an interest in the public open space areas and in the children’s play areas.  However this appears to be ignored in the current planning applications lodged with East Ayrshire Council.

 “After being contacted by several constituents at my constituency surgery in Darvel Town Hall last Friday I am breaking a long held position of not becoming involved in planning issues which are rightly the remit of East Ayrshire Council and its elected councillors.

 

This issue is not just about planning it is about the rights of those living in a long established community. I am appalled that their rights which are contained in their Title Deeds appear to have been ignored and not mentioned in the applications.

 

My constituents bought their homes and were granted an interest in the public open space areas and in the children’s play areas. These interests must be upheld by the developers and East Ayrshire Council or the purpose and intent of title deeds is redundant.

 

I would hope that East Ayrshire Council refuses the application on the grounds of loss of community amenity and my constituents do not need to revert to expensive legal action to uphold their rights”.
